Getting oriented to Westchester Surrogate’s Court

A letter mentioning Surrogate's Court can sound intimidating. This is the New York court that handles matters involving wills and estates, among other responsibilities. Knowing where it is, why the county matters, and what information to gather can make the next conversation less confusing.

The court is in White Plains

Westchester County Surrogate's Court is at 111 Dr. Martin Luther King Jr. Blvd, 19th Floor, White Plains, NY 10601. It is not Mount Vernon's city court. Use the official court directory linked below to confirm contact details, hours, and current notices before traveling.

Law Office of Andreina I. Rosa, Esq.'s office is at 126 West First Street, Mount Vernon, NY 10550. A meeting at the law office and a court visit are different appointments. Confirm where you are expected before arranging transportation or time away from work.

Why Westchester may be the right county

For a person domiciled in New York, the estate proceeding generally belongs in the county of that person's domicile at death: their permanent legal home. The location of the attorney's office does not determine the county.

If your parent lived in Yonkers but died in a hospital elsewhere, share both facts. If they split time between New York and another state, bring information about their homes and recent moves. Do not choose a court based only on the place of death.

Prepare a small, useful folder

Bring what you have; mark missing items on a separate page. Clear records help the attorney see whether there may be a will proceeding, an administration, or another appropriate step. A court form alone cannot answer every ownership or family question.

  • The original will, if found, and death certificate.
  • Family names, relationships, addresses, and any earlier deaths.
  • A list of accounts, property, debts, and named beneficiaries.
  • Copies of court notices and any existing file number.

Use the official resources

The court directory includes contact information and a Pro Se Help Center listing. WebSurrogate provides access to certain estate case information and records. Online access has limits, so a search result should not be treated as a complete account of everything filed.

If you receive a citation or other court notice, save the whole document and envelope. Note the stated date and ask what response is needed. Avoid signing a waiver simply because someone describes it as routine.

Make the consultation about your next steps

Ask which court is appropriate, who may apply, what needs immediate attention, and which documents remain outstanding. Mention any language or accessibility needs when arranging assistance. This guide offers general orientation; the court's current instructions and your family's circumstances need individual review.
