Put your wishes into words

A will shaped around your wishes

A will lets you leave written directions for the property that passes through your estate after your death. Law Office of Andreina I. Rosa, Esq. helps clients in Mount Vernon and the surrounding service area think through those directions, the people involved and the questions that need individual attention.

Discuss your situation

Choose who receives property and who helps

A will can name beneficiaries and nominate an executor to carry out its instructions, subject to court appointment. Parents can also nominate a guardian for minor children, subject to court approval. Discuss backup choices and what should happen if someone you name cannot serve or dies before you.

Look beyond the will itself

A will does not necessarily control every account or piece of property. Assets with valid beneficiary designations or survivorship rights may pass separately. Reviewing those arrangements together helps identify where your written wishes and your account records may differ. A will also does not authorize someone to make decisions for you during your lifetime.

Signing and safekeeping matter

New York has specific requirements for executing a will, including witness requirements. A signature or notarization alone is not enough for an ordinary will. Once signed, keep the original somewhere safe and accessible when needed, and let an appropriate trusted person know where it is.

What to bring to the conversation

Bring an earlier will if you have one, a general property list and your questions about family circumstances. You can discuss a first will or review an existing document with Law Office of Andreina I. Rosa, Esq. at 646-899-4969.

  • Names of beneficiaries and possible executors.
  • Any concerns about children or someone who needs ongoing support.
  • Recent changes in your family or property ownership.

QUESTIONS YOU MAY HAVE

Let’s clear a few things up.

Does having a will avoid probate?

No. Probate is the court process for establishing a will's validity. Some estates may qualify for a different procedure, depending on their assets.

Can I change an old will by writing on it?

Do not assume handwritten changes will work. Ask about preparing a new will or a properly executed amendment, called a codicil.

What if I already made a will in another state?

Bring it for review. Its effect and any appropriate updates depend on the document, your current circumstances and the applicable law.
